Why were you punished?: 3.4 - User broke gunpoint by turning around and not listening to verbal commands given by the Officer in front of them that had their sidearm in passive stance clearly visible. Once the user had no clear chance of escaping (and failed to do so) they turned around with a weapon, pulled it out and killed them.
Why should this appeal be considered?: In my defence, gunpoint is valid as soon as the gun is pointed at a person, not when commands are given. With this being said, I ran from the gunfire in order to make the cop believe i was running to preserve my own life. As i was running, I heard him tell me to put my hands up, so I turned around to check if he was actually gunpointing me, which in my point of view he was not. This let me pull out my gun and shoot him "safely".
At the start of the situation, he readies his gun as I run away, but I think its rather unfair to think that someone would be able to notice that in such a short, tense situation.
The argument may be made that you should assume that someone who has their gun at their hip is most likely gunpointing you once they start giving commands, however it is extremely common that this isn't the case. For example, there are many cops that keep their guns at their hips or pointed down while asking a suspect to put their hands up hoping that the criminals would comply without needing to gunpoint them.
There has been many situations identical to this where punishments were not given and no wrongdoing was found after looking at both POV's.
