Absoloutely, it's not a solely criminal thing, but the rules as they stand make it easier for criminals to do than cops which may make it a more frequent occurence that crims shoot first.
Sadly there exists a disconnect between player incentives and ideal RP incentives which would make this idea unpopular.
The main motivation of taking a hostage should be to avoid a shootout, and any actions performed thereafter should reflect this.
