That would be fairly realistic too. There are criminals that don't buy the permits in the U.S. like in chicago. There are also the good citizens that only use guns when they need defense.

It clearly looks like self defense is involved. Also I would argue neither of the rules you listed fall into this category of what you are trying to argue. Especially 2.5 should not apply.
