Punishment Type: Ban
Punishment Subtype: Server Ban
Appeal Type: Dispute[Evidence]
Which staff member issued the punishment?: @jams
How long were you banned/blacklisted for?: 5 Days
Your Steam Name: jbooling2646
Your Roleplay Name: Red Smith
Your SteamID: STEAM_0:1:410922628
Why were you punished?: 1.1, 2.5, 3.4 - User hit another user with a bat who he believed to be apart of a separate situation when they weren't, they did so in front of police. They then chose to be disrespectful to them in OOC.
Why should this appeal be considered?: I would like to appeal my 5-day ban because I believe the punishment was inconsistent and unfair.
The original situation involved me hitting another player with a bat after the police had turned the corner and were no longer directly at the scene. I immediately ran away afterward. During the initial staff sit, I was issued only a warning for this incident, and I accepted that decision.
However, after the report had already been closed, another administrator reopened an F6 report and changed the outcome from a warning to a 5-day ban. From my perspective, it felt like the report was reopened to find another reason to punish me rather than to fairly review the situation.
The second reason for my ban was Rule 1.1 (OOC disrespect). I believe important context was ignored.
The other player, MJ, was the first person to start insulting me in OOC and LOOC. I only responded after he had already directed multiple insults toward me. I have video evidence and screenshots showing this.
Some of the things MJ called me included:
* "Ghetto thug"
* "Ape"/"monkey"
* "Chocolate" comments
These remarks are clearly offensive, and I viewed them as racist. My in-game character is white, so there was no roleplay reason for these comments. Regardless of who they were directed at, calling another player an "ape," "monkey," or making "chocolate" remarks in OOC is inappropriate and should not be considered acceptable.
During the staff sit, I was told that MJ would receive punishment as well. As far as I know, nothing happened. Instead, I was the only player who received a 5-day ban after originally being given only a warning.
I also don't believe my prior record should outweigh the fact that another player initiated the OOC harassment. I understand that my record was mentioned, but MJ also has multiple prior warnings and bans, including for Rules 1.1 and 2.5. If anything, that history should have made it even more important for him to avoid making insulting or potentially racist remarks toward another player.
I'm not trying to avoid responsibility for my own actions. If I broke a rule, I understand receiving an appropriate punishment. My concern is that the punishment was escalated after the report was already resolved while the player who initiated the OOC insults appeared to receive little or no consequence.
I respectfully ask that the staff review the evidence I have, including the video clip and screenshots of the F6 report and chat logs. I believe the full context shows that the situation was handled inconsistently, and I ask that my ban be reduced or removed based on that evidence.
Thank you for taking the time to review my appeal.
