I said "Put your hands up" but didn't realise I was still in whisper, then while swimming the animation looked like he was pointing his gun towards me so in the moment I shot thinking my life was in danger.

I am sorry for this as reflecting over it from the other side it wasn't fair, I didn't manage to find the gun but I wouldn't mind paying for it.
