There is no need to wait for a response given the evidence. I am accepting this based on him being unarmed in the area of a shootout. This is because when the person came up the stairs, you were on whisper and out of sight until he started equipping the weapon. You did correctly have him under GP, but he couldn't stop equipping the weapon. Then he has the weapon in passive, which then allows him to shoot at you.

Despite this, he shouldn't have entered an ongoing shootout so he will receive a three-day ban for 3.4.
