Punishment Type: Warning
Appeal Type: Dispute[Evidence]
Which staff member issued the punishment?: @torbizzle
How long were you banned/blacklisted for?: Not Applicable

Your Steam Name: Dahweeble
Your Roleplay Name: Leonardo Snow
Your SteamID: STEAM_0:1:441719778

Why were you punished?: 3.4 - User pulled out their firearm whilst under gun-point by police, resulting in their death.

Why should this appeal be considered?: I'd like to start by saying that I believe that the demo unfortunately is a bit different than how I can remember it happening on my screen. On my screen if I remember correctly it wasn't as clear as it is in the demo and my POV was looking a different spot, the last part might not be certain though. When looking at the clip I suggest you imagine the gamertag not being there as it definitely makes it seem like I had more time to react than I actually did. I also encourage you to not slow the footage down the first time you watch it. Anyway, when he eventually peeked me, his gun was in the lowered position and because of this it was well camouflaged on his armor and/or clothing (for this part I suggest you slow it down to see how well hidden it actually was). The only time you can argue it was not well hidden was right before he actually pointed it which would be about 0.1 seconds before he was no longer visible on my screen. De facto from when I saw him and until I have my gun out it was around 0.5 seconds and possibly less. And in this time I'm supposed to see his lowered gun that is camouflaged on him. He also did not tell me to put my hands up because his mic was apparently muted, if it wasn't it's a great chance that the whole outcome would've been different as I might have had more time to react. If you also add any input lag from when you actually click your firearm bind (2 for me) as well as the time before it's even visible in your hand you can say it's even less time before my gun was out... In this situation I believe I had a good fighting chance and I assumed he'd be distracted with my friends in the Volkswagen you see in the clip, however he didn't care one bit about them and died because of it. The environment is also dark and officers in the US try to have dark clothes to be less visible, which is different than in for example the UK where they have very bright clothes. This makes it even more hard to see.

Additional Information: There were definitely things he could've done better in this situation as well, for example having his mic unmuted and pointing the gun at me which would make everything a lot more clear for everyone. For example I recently made an F6 on someone because they tried to mug me while I had a gun out the day before, however A1L (if I remember the staff member correctly) argued that it wasn't visible for them because it was in the lower position and therefore they were not punished. Which I agreed with him on because this is something that can happen to anyone. I believe that is applicable in this case as well. This was obviously not on purpose and I always follow 3.4 and any other rule to the best of my ability.

So what you're saying is that you misjudged the situation, however looking back at it would've acted differently because what you did was, in-fact, against the rules?

No, what I'm saying is that I had too little time to react, especially considering how hard it is to react to something that was nearly impossible to see. I wish I had the original POV, however I didn't clip it, so I have to explain what I see in this clip unfortunately... I also had a really good chance to fight back considering my buddies were right next to him and you could argue that the officer should have shot me because it was the safest option for him because my buddies were going to kill him anyway, which would make it so I definitely should have done what I did. The only way the cop could have lived in this case was by shooting me as he then would've had a chance to kill my friends.

You quite clearly failed to comply with the officers gunpoint and to be frank, you even admit to this in your dispute. From the point the officer got out of their car and walked around to the other side, where you were lying ragdolled, their weapon is very clearly visible. You not paying attention to this doesn't matter when judging whether a rule was broken or not, it's just your own fault and bad luck.
