Punishment Type: Ban
Punishment Subtype: Server Ban
Appeal Type: Dispute[Evidence]
Which staff member issued the punishment?: @Bean Can
How long were you banned/blacklisted for?: Permanent

Your Steam Name: Spooky Pyro
Your Roleplay Name: Mutombo Kinte
Your SteamID: STEAM_0:1:69780698

Why were you punished?: 1.6 - The user was suspected of rule violations. I demo requested them, but the demo request failed. I opened a report with them in-game, and they stated they didn't have that demo. They will be banned until they can provide the demo that was requested.

Why should this appeal be considered?: I am kind of confused what the ban reason is ,of course it is for 1.6 but idk why the f6 was made, because I was reported for breaking raid timer, then it changed to cheating and now it is back to breaking raid timer.

Regardless, the reason for the f6 to have been made is because I was suspected of breaking raid timer and raiding the same property 3 times in 1 hour. Johhny Pablo already dealt with this f6 because we had not raided that property at all until the third time we came around, the first time we tried mugging someone outside (to which we died) and the second time we were rdm'd.

The next day, Bean Can makes an f6 on me because the prompt to demo request was failing so he asked me to manually go get the file. When I go into my phdemos file I was unable to find it. I went trough my ssd and hard drive but the demo file was in neither. I then told Bean Can that he is trying to request a demo file that doesn't exist, and I also told him that the prompt for demo requesting wasn't showing up. He then asked me if I had deleted the file , I obviously didn't, and then claims that I was cheating.

I don't understand why he is throwing cheating accusations based off of one demo that he hasn't seen. I also don't see why he didn't demo request Johhny Pablo or the people reporting us instead, their demos can see the rule break and they were more available, I had gotten off before the actual f6 was made on me so I was unable to immediately respond. In my opinion, he is only an enforcer and he acted out of line by investigating what he thinks are cheats without a secondary opinion from someone who knows more and more evidence. I understand that Bean Can is a long time player but the Perpheads environment, especially in pvp, has a massive skill gap and has drastically changed since he was last playing.

In the evidence tab there is a google drive with Johhny Pablo's demo that shows us not breaking raid timer. I was also in proximity for majority of the time that the demo was recording and you can spectate me in them for all the times I was shooting, you can also hear my shit callouts because I was very lost in all interactions. If you truly suspect me of cheating then I insist on spectating me the entire time in Johhny's demo. You may also request more demos where I actually killed people instead of tapping 3 guys with an h&k and body shotting someone with an aug. It may not be 1:1 but it is the only thing I can provide. In the additional information tab you can see the demo files that happened before and after the raid.

The only rule break I have commited was storing an aug and scar before fully clearing out the property. We had not fully cleared the building so I assumed it was safe to store, I was wrong. Either way I killed the last defender and broke 3.18

I have never been shy of accepting demo request and there is no gain to get banned over 3 guns. I also am not and never had been cheating. If it is such an issue for breaking 3.18 I am open to returning the mp5k, scar, and aug that I got from killing those guys and receiving other punishments that aren't permanent.

There is no demo of the exact events that happened during that raid except for Johhny Pablos. There was no raid timer break and I think jumping to a cheating accusation because I fail to have a demo is a hasty action. My best guess for why i don't have the demo is that I demo restarted before the server demo restart happened. I assume that something broke mid way and the entire demo was lost on my end.

Additional Information: https://drive.google.com/drive/folders/1md0cbO0sRRmQP5pDhvwsaIs3DGQrz-gC
The drive has the demo file of what came after the bunker raid along with a ss of my phdemo file showing that there is a gap between files.

Hello, I am completely uninvolved, however I believe that I have information that may be very useful to the report so I would appreciate if this is read. I had a report I opened myself on another player and I believe it was the mod @Daan (Lucius Husky) who was talking with me. In the report I offered myself to go into my demos so I could find out which player I was reporting for I think it was fleeing a simple traffic stop. Upon saving my demo, I tried looking for the correct file and could not find it. All I could find was another demo minutes later which made absolutely no sense. In the report I made, the moderator tried demo requesting me and even they could not find the file. I checked everywhere, demos, recycle bin (if i accidentally deleted it), other gmod folders and I could not find anything. In the report I was told if anyone reports me and that demo is needed, I would be in trouble but I was okay at the time because I was making a report and not someone against me where the demo needed to be investigated for my actions. I am saying this because I believe there is a chance that something could've went wrong with saving the demo, and possibly it could happened to the user in this dispute as well so I think this should be considered in regards to the rules around demos. This happened about a week ago.

We will remove the ban for now, but you will be contacted by a staff member to have this situation re-investigated in the near future.
