Punishment Type: Ban
Punishment Subtype: Server Ban
Appeal Type: Dispute[Evidence]
Which staff member issued the punishment?: @Bean Can
How long were you banned/blacklisted for?: 1 Week

Your Steam Name: cron73
Your Roleplay Name: Joshua Black
Your SteamID: STEAM_0:0:678201053

Why were you punished?: 3.4, 3.18 - The user remained inside a warranted property that was just raided; shortly after killing the cops, he started to store the weapons in the property's storage instead of fleeing.

Why should this appeal be considered?: Ok so lets get this started, firstly the 'apparently warranted property' which was 203 was getting raided which some people in my org were basing in (I WAS NOT BASING THERE, I WAS BASING IN 201) they got raided by pd, i flanked for them. Having just wiped pd, i dragged all the bodies inside of the property, and put all the guns inside (there was multiple planters inside aswell btw). Having waited maybe 5 mins and fully clearing the outside of tidals, i came back to 203, put the guns inside of the org storage, and returned back to 201 which I was basing in and wasn't warranted at all and had no previous pd raids or anything due to the owner johnny pablo dying, i simply just carried on chilling there, so the 'remained inside a warranted property' is not the case AT ALL. 1 more thing to add which bean can wouldnt live down, all the cops are dead so the situation is now over, the owner of 203 is also dead, so its no longer warranted either. So please tell me how the cops will continue to have evidence to breach, and why would they anyway? they would be breaking nlr if they return. It was no longer warranted. But the big picture here is that i wasnt even basing there lmao. i simply flanked 1 time, and was probably inside of the property for a total of 2 mins until i left.

We are accepting this on the basis that you have the lowest culpability out of everyone. Tidal 203 was not your primary residence, Tidal 201 was, and 201 was owned by Johnny Pablo who died in the shootout for 203. You only assisted in dragging bodies into Tidal 203 and storing the weapons, and returned to 201 each time which had never been warranted. Because the shootout was entirely contained inside or around 203, there would have been no Police interest in 201 whatsoever.

It could be argued that you dragging the bodies into 203 was also for your own benefit as it would have made it harder for Police to obtain DNA on you and warrant you had they decided to return to reattempt the raid, and you staying in 201 in such an eventuality would have been fine because - again - 201 wasn't owned by you and there would have been no DNA to obtain on Johnny Pablo as he had died. As such, you only perhaps 'overstayed' during the moving bodies/storing weapons by a couple of minutes maximum which is within tolerance.

I should clarify for observers, however, a point you have raised as part of the dispute:
1 more thing to add which bean can wouldnt live down, all the cops are dead so the situation is now over, the owner of 203 is also dead, so its no longer warranted either. So please tell me how the cops will continue to have evidence to breach, and why would they anyway? they would be breaking nlr if they return. It was no longer warranted.
This interpretation by yourself is incorrect. Yilmaz Yilmazen - the owner of 203 - dying in the shootout and the warrant vanishing, and all the Police on-scene dying and the bodies being dragged inside does not preclude the Police coming back and attempting to re-raid after their NLR ends. This is because if any single government employee had remained alive and had knowledge of the Police all dying at the shootout, they could simply remind Police of that fact once their NLR had ended.

This is why we want people to leave after shooting Police at their property, even if the property owner dies in the shootout. The others who actually remained in 203 opened themselves up to the risk of being there if/when that eventually happened, which breaks 3.4. What the others inside 203 who have been warned should have done is moved any drugs that were not nearly done/replanted drugs into 201 which was objectively safe, or at the very least simply exited 203 and waited inside 201 until a significant enough amount of time had passed - say 20-30 minutes - and then moved back into 203 if there was no repeated cop presence.

As such for anyone else reading this who received or will receive a punishment for actually staying inside 203 after, don't bother disputing it.
