You must not confiscate weapons or evidence when there is an immediate risk of harm, unless you are unable to watch over it and leaving it would risk public tampering. You also must not confiscate when highly outnumbered or are very likely to lose. This includes impounding vehicles."

Additional Information: Upon arriving on scene, I entered the lobby of the office building where the shootout had occurred. Given that the lobby is a publicly accessible area, I determined that confiscating the weapon was the safest course of action to prevent any further risk to civilians. Had the weapon been located in an area with limited or no public access, such as an upper floor, I would have left it in place. I then proceeded upstairs immediately to locate and engage the attacker.

The rules do state that you may confiscate weapons that you cannot watch over, the purpose of this is to be a help for evidence that cannot be secured by other means outside of public buildings like a street. However, the weapon was inside a publicly accessible building which makes it less likely to be tampered with like a weapon exposed open on the street. If the building was properly secured with a perimeter or barricades it would increase your chances of securing evidence, letting you watch over them.
We sadly see no barricades or perimeter set up in the provided evidence. No one even bothered to look after it and not even 30 seconds after the flanker makes it up the stairs it becomes confiscated while shots are still being actively fired and cops are dropping.

3.17 also states: "You also must not confiscate when highly outnumbered or are very likely to lose.". Looking from the logs it's fair to say that cops lost this raid shortly after due to the flank so this already invalidates a lot of the points made for this dispute.
