Gun in my hand, giving orders and i had a gun aimed at you as i gave orders. You were stationary when you were under direct gunpoint and already given orders yet you drove off. At the time you are wanted and armed, clearly 3.4 Just because I didn't turn your car into swiss cheese when I had all the right to do so doesn't mean it wasn't 3.4.

It's very difficult to take two people like this under gunpoint. Had you approached earlier to where the 1st person couldn't have driven off and distracted you, this would have been 3.4. You issued a command and then turned your attention away from your suspect which gave them all the time they needed to begin accelerating seeing as the car was already on.
