Punishment Type: Warning
Appeal Type: Dispute[Evidence]
Which staff member issued the punishment?: @Medium
How long were you banned/blacklisted for?: Not Applicable

Your Steam Name: Pufferfish
Your Roleplay Name: Steven Pablo
Your SteamID: STEAM_0:0:576024407

Why were you punished?: 3.5, 5.3 - User watched the location they died in with an active NLR timer and then assisted a friend who was part of that same situation, with the timer still active.

Why should this appeal be considered?: To start off i was watching the raid from main street, where i had just respawned. No part of rule 3.5 states that you cant watch the ongoing raid, it only states returning or interacting which i had not done either part, i only stood beside main street and watched the shootout occur as i had died during it quite early on.

Medium stated "you were watching the area which you died in almost your entire NLR timer" - In almost my NLR timer, not within it. Therefore if it was "almost" it does not count as NLR, i also did not interact nor return to the same situation as i was watching from the area i had respawned in.

Rule 5.3 states that you can not return to the situation you died in if it is ongoing, which i did not do while it was ongoing. Medium stated "the friend you were assisting was actively shooting cops from the same situation." which i did not once assist him during his shootout with cops, i was merely watching.

The action request against me was for taking a weapon from the shootout although when i took it the shootout had finished, the area was clear and i was acting off of my new NLR, seeing a cuffed unattended guy with a gun by his feet is not breaking NLR as i acted in my new life with no NLR timer. there was only cops handling clean up and the weapon i took was far enough away from that situation that had ended, this area being in mainstreet, i never returned to the situation while it was ongoing as i knew my friend had died having not heard gunshots anymore.

Hello as the person who had the gun fight I had no knowledge steven was on market street, i had no help from steven at all in the end of the raid

Hello, as the person who was in a shootout with you, shortly after you had been shot unconscious/dead, Steven stole my weapon while I was cuffed, essentially assisting in the situation he had previously died in. As he had secured a weapon, he otherwise wouldn't have been able to secure.

yea me dead therefor new sit!

We deem this warning as valid with the following reasoning:

You were watching a shoot out at a distance from a situation that you were involved in but respawned with NLR active for 5 minutes.
You did not create a large enough distance and decided to stay unreasonably close to watch a shoot out after respawning with your NLR still active.

3.5 New Life Rule (NLR)

[...]You must also stay a reasonable distance away from your NLR zone.
While doing so you gathered information related to your death which is in relation to the current on-going raid. This is described in 3.5:

3.5 New Life Rule (NLR)

[...]You must also not act on any information you gain relating to your death while your NLR timer is active.
Thanks to this information you gathered with your NLR still active you saw a person involved with the raid get gun pointed and put their hands up, dropping their gun. Your NLR was still active when retrieving the weapon but this wouldn't have changed the fact even if you waited for your NLR to run out and then go to retrieve the gun due to the information you gathered with NLR being active and you watching the shoot out.
