Punishment Type: Ban
Punishment Subtype: Server Ban
Appeal Type: Dispute[Evidence]
Which staff member issued the punishment?: @GamingPeach
How long were you banned/blacklisted for?: 5 Days

Your Steam Name: !Thorgal
Your Roleplay Name: Ella Welch
Your SteamID: STEAM_0:1:69780698

Why were you punished?: 2.5 - User killed another user without giving sufficient time for them to comply with their orders

Why should this appeal be considered?: Although the time for me to kill him was in 3 seconds the process behind my reasoning to kill him was justifiable. The door was not opened by him and John Hob immediately rushed in so it should have been easy to register that it was a raid and he was going to get mugged. Ashur (in his restless need to click S on his keyboard) walks outside despite seeing the visibly armed John Hob.
While these three events are happening I am saying "hands" repeatedly. As I am saying "hands" Ashur decided to not stand still at all but instead to walk outside. This would put him at breaking gun point but not intentionally or at a level which would make it 3.4. Instead of immediately killing him while he walked out I gave him the time to stop moving and put his hands up. He does not do that and instead does a 70 degree turn then followed up with a 20 degree turn to look at me. Him turning instead of stopping and surrendering set himself up for death because that was too much stalling. Even in his own POV he doesn't go into the emote wheel.
In any mugging or gp'ing an act of immediate disobedience ,no matter how quick it was, would warrant a KOS. This is practically the same approaching someone with a gun out at drug dealer and shouting hands as they run away. They may only hear you once and have the time span of ~3 seconds but it would still be a valid kill.
There was no reason to waste time by turning towards me. He knew very well the instant "hands" was uttered out of my mouth that he was being gp'd and he did stop moving but he did not immediately put his hands up or use the emote wheel for a surrender.

After reviewing the evidence provided, we have deemed that you acted too fast. It would have been more appropriate to allow the other party more time to react to your commands. There were more than enough people that were involved in said raid to keep two members of the raiding party to gunpoint those who were caught off guard, as you can also see, the reporting party was also unarmed, not even visibly armed.

Considering we would deem this as a silent raid, and the rules specifically state "If you suprise someone who is unarmed during a silent raid, you must not kill them on sight", we have deemed that it was unfair to kill them straight away and should have allowed them more time process what was occurring and to attempt to put their hands up, had they not, killing them would be fine.

The 2.5 ban is deemed valid.
