Suggestion Title: TFU place search warrants
Suggestion Description: As a TFU you get the ability too breach properties without a warrant, it makes sense for us too be able too place a search warrant incase we all die while raiding the property.

Why should this be added?:
- Makes sense incase we all die

What negatives could this have?:
- Potential for misuse but TFU has its own punishments along ia

What problem would this suggestion solve?: no problem really just convivence and a backup layer incase all pd die

So, we have emergency searches for when you have immediate reason to enter a property. Any rank can perform an emergency search, such as enter a property that has open doors if they have grounds to. TFOs are granted extra powers to assist in performing emergency searches and/or execute search warrants. All officers are exempt from burglary and trespassing if they have to preserve life or execute their duties, such as drugs, warranted suspects, etc.

Search warrants are placed when entry is not immediately required but there is reason to search the property.

I don’t think we should broaden who can issue search warrants, as it is rare that TFOs are in need of a search warrant, they explicitly have the powers to perform emergency searches.

Furthermore, search warrants allow officers to breach properties without any other immediate cause than the search warrant. This decision should be reserved for a supervisor to decide, as they are proven to be responsible in making decisions that could impact what other officer do regarding property searches

So when a SO TFO spots wanted people within a property what should their plan of action be if no one SGT+ is available per chance? Also the last paragraph is rather contradicting as SO TFU literally can still breach and what not regardless and have numerous responsibilities to do so, so would expanding to search warrants be that big of an impact?

If you disconnect from the server, and you have placed a search warrant. The any officer could use that search warrant as a reason to breach, even if they don’t have immediate visible cause.

This is regarding supervisory powers to issue search warrants, not emergency searches.

Anything to have warrant + DNA sampler without having to do OR’s, scrap ts already
I think this is just a shallow way to voice your opinion on this when realistically it is something that should genuinely be considered.

He isnt asking for the ability to give all types of warrants and he didnt even mention the DNA sampler. He is exclusively asking for STFOs+ to be able to place search warrants, which isnt outrageous at all considering they can literally do everything around a search warrant but place it. The increase in power he is asking for is minimal and entirely for the quality of life for everyone on duty when there isnt a supervisor but there is a STFO.

And also, perhaps you may have forgotten during the duration of your ban but there is an activity requirement that comes with STFO so the mention of not having to do ORs is entirely useless and non-productive.

Furthermore, search warrants allow officers to breach properties without any other immediate cause than the search warrant. This decision should be reserved for a supervisor to decide, as they are proven to be responsible in making decisions that could impact what other officer do regarding property searches
This is the only possible disadvantage I can see for something like this, but even if a supervisor places the warrant any officer can act upon it.

Then archive it before leaving? Also the disconnect from the server thing applies to both SO and SGT+ regardless.

I'm using emergency search as an example as TFO's still hold a high responsibility upon being granted STFO so to act like search warrants is suddenly a stretch is rather extreme.

Id rather play the game without limiting myself cheers. And you’re acting like you can’t just easily get the activity requirement.

Limiting yourself in what sense? If youre talking in the general sense of the suggestion then this idea gets rid of limits but if youre talking about activity requirements then that is something you decide whether or not you want to do, its not forced on anybody. It is also equally as easy to do 1 OR as a corporal or 2 ORs as a sergeant as it is to play for 2 hours a month.

Regardless this means nothing in the context of the suggestion.

If the search warrant does not need to be in place when you’re not there, then an emergency search is more than enough? I’ll write a better reply up later - when not at home - this is a good discussion and I’m sure we could sway eachother either way!

Well it is relevant whether you think it is or not buddy, i only go for sgt for the cool stuff, if tfu had more powers such as placing warrants then that's fantastic and people won't have to write the yap yap sahur or's for a rank they ultimately aren't arsed about

What are you on about I'm in circles now xd.

Hello, I am able to give you a better articulated response now

Any Officer Entering Private Property:
Under law 3.8, any officer can enter a private property if it is necessary to the performance of their duties, this isn’t limited to just TFOs

TFOs and Emergency Breaches:
Under the Emergency Search policy (well defined in the TFU handbook - section 6) you can enter a private property if someone is unconscious or critically injured or a preventable crime is ongoing in the property: the caveat here is that you need evidence beyond reasonable doubt that this is ongoing.

TFOs are more likely to require emergency searches, actual breaching of a property, so they have the tools to do so, to better perform their duties.

As a question, would you want TFOs to be able to do this whether they are in gear or also when not in gear? If they are only allowed to do this in gear, why does that make a difference, if their certification should justify them issuing warrants?

Search Warrants:
Unlike arrest warrants and emergency searches, search warrants only require an officer to demonstrate they reasonably believe that a crime has/is being committed on the property, it does not require evidence beyond a reasonable doubt (as stated in law 3.5). In my opinion this makes search warrants require even greater responsibility due to the wording of the law; this is why I believe this should be restricted to supervisors.

Furthermore, when a search warrant is issued, the officers who execute the warrant aren’t responsible for the reasoning for the search warrant - ie if a supervisor places a search warrant that is later shown to not have had sufficient evidence, the officers who executed the warrant wouldn’t be held liable for the reasoning of the search warrant (to an extent obviously)

So, similar to arrest warrants, supervisors are proven to be responsible enough to understand what classes as enough reason to issue any form of warrant.

TL;DR
Search warrants don’t require as much evidence as arrest warrants and/or emergency breaches so it poses greater risk to increase what officers can place it: only supervisors should be responsible for issuing them

Not exactly a fan of this as a search warant permits the officer and anyone else to conduct a full search of the property or to the scope defined within the search warrant...
