"There are situations where you can kill a hostage and situations where you cannot." - @Efan (sorry if the ping bothers you but i quoted you so i don't want to talk about you without you knowing)

This was very blunt and I didn't really understand the parameters that define when it is allowed to kill or even just hurt the hostage and when it is not allowed. I hoped maybe examples could also be given.

Solution
You can only kill the hostage in circumstances where keeping him alive doesnt benefit you anymore and also negatively affects you. Lets say for example your hostage is shouting your location or other important information, another situation would be if the police is on-scene but are not following any demands or are not making any efforts at doing so.

If keeping the hostage alive benefits you then you can almost NEVER kill them, for example the police is following your demands and you might have a chance to get away, or the hostage is very compliant and killing him would only make unneeded sound or leave DNA.

It usually depends on a few factors but its also common sense in most cases. If you killing the hostage does NOT benefit you and...

Solution
I generally never kill a hostage unless they snitch after the fact, it's almost always better to keep them alive as a bargaining chip

Let's say I take a hostage and the hostage is not complying putting me at a risk of getting caught already, like I am talking blatant 3.4, If I shoot him then start shooting at cops AFTER that would be valid in theory then right?

Usually if someone does indeed break 3.4 then he is a threat to your freedom anyway as they either run away and you risk having them snitch on you or they could become an actual threat by them pulling weaponry, so shooting them then is fine if it does benefit you yes.

Whilst killing the hostage is not beneficial in most cases, hurting the hostage can be VERY beneficial, but it can go very wrong.

Shooting the hostage in a non-vital part such as the legs, gives you the chance to put a timed clock against the negotiator. This will make them act faster and usually less organized.

Like others pointed out. Use common sense. If everyone is cooperating, there's no reason to hurt the hostage.
