you did not have a clean shot and I had easily accessible cover which I could take in under a second. To my knowledge slipping out of gunpoint around a corner is allowed if given the opportunity

The view was too obstructed due to the fence and by not being on even levels for gunpoint to take effect. As @Mooo said, it wasnt a clear shot and he had a very good chance of running in time and pulling a gun to defend himself.
