Punishment Type: Ban
Punishment Subtype: Server Ban
Appeal Type: Dispute[Evidence]
Which staff member issued the punishment?: @Draxen
How long were you banned/blacklisted for?: 4 Days

Your Steam Name: piesangsaregood
Your Roleplay Name: Coubus Thunderpoes
Your SteamID: STEAM_0:0:687447323

Why were you punished?: 5.1 - The player mugged another player right on the edge of the yellow zone on the mugging map. The location where the mugging took place was very open to the public, and no action was taken to move the victim to a less exposed area.

Why should this appeal be considered?: First of all, I did not mug the person on the edge of a mugging zone. The mugging zone ends roughly half way into the bridge and i mugged them far beyond that.

Second of all, the rule 5.1 states "You must not mug someone in public view or force them out of it". The mugging zone that we were in happened to be next to a road and in view of the public eye making it practically impossible for me to hide the mugging especially considering its original location. This is the same as the rest of the forest district. I have mugged hundreds of people on the side of the road in forest and never got in trouble for not moving them to a more hidden area because, it is a mugging zone at the end of the day that just happens to be on a road that people are inevitably going to arrive at during the mugging. If it took place nearer to boat house or farm i would hide the user there however, those options (the only pieces of cover nearby) are very far away and simply mugging and leaving the user would bring much less attention then gp them all thhe way to these locations , considering the time difference(me going afk for a few seconds after the mug is not a contradiction to this because i had something to take care of irl and couldnt have changed that either way the mugging took place).

JUSTIFICATION FOR MY ACTIONS

As i stated in the report, the only "less exposed area" nearby to the place that the gp was initiated is either behind farm or in boathouse. Nobody wants to be forced all the way to either of these locations whilst being gp and then mugged which is one of the reasons i chose not to do this. The second reason i chose not to force them away from there is because the rule states
"You must not mug someone in public view or force them out of it". The user was pretty obviously already in the public eye and the only other precaution that i could have taken would force him far out of it.
Second of all , when mugging the user I did take precations by having several people watching the road ahead and notifying me about any passers by (only 1).
Thirdly , another reason i decided to mug the user on spot and leave is because of the assumption that they could live at farm. Knowing the people in farm and the user we mugged we knew it was likely they were basing at farm and moving them closer to it would present their ability to hear the mugging. This ruled out the possibility of moving them closer to farm making boat house the only option which I decided was simply too far and frustrating for the user being mugged.

We are going to remove the ban.

There just isn't that much you can do in such an open area, although you could have made a little effort to hide them behind the car. You mugged them in a yellow zone, so initiating the mug was completely valid, and we feel the lack of cover ultimately didn't matter that much.

The ban will be removed from your record.

EDIT:
The ban will be removed, but you are not fully absolved of wrongdoing, as no precautions that the mugging map asks you to make were made.

I think it is necessary to make some clarifications as the decisions made here may be relied on for future precedent. While I do appreciate that that specific spot is hard to work with (which will be addressed later), we have yellow zones on the map and the clarification text for a reason. That reason being that we want players to take reasonable precautions when mugging in zones that are not as hidden as others.

The biggest issue here is that even after you had been spotted by a random passer-by, you made no attempts to hide yourselves or your mugging victim at all. Based what is written on the mugging map, you absolutely should have made some kind of effort to hide yourselves, either by moving your victim behind the car or dragging them to the fence to be further away from the very open street leading off a highway junction. Especially after being spotted by somebody, you should have tried to hide yourselves better.

You did not do any of this. These resources are written to help you comply with the rules as they are intended to be enforced. As such, the initiation of the mugging was fine, but continuing the mugging without precautions was not.

Now, I appreciate that the wording of the rule may have implied that you weren't allowed to move him, but what is meant by "public view" in the rule refers is places you can not mug or initiate muggings at all. The rule has been changed to "public places" instead to make the link to the mugging map clearer. I also appreciate that yellow zones are typically seen simply as muggable zones and that enforcement is inconsistent. This will be addressed internally as well.

As for the spot itself, most of us agree that it needs to be moved back regardless of the decision here, simply because of how visible it is. This will be addressed in the future too.

Whereas I do find that continuing the mugging in "public view" was a breach of the rules, I also do not find it reasonable to punish you given that even as staff members, we could not all agree whether this was against the rules or not. It would be unreasonable to expect you as a regular player to have made that determination in the moment.
