Punishment Type: Ban
Appeal Type: Dispute[Evidence]
Which staff member issued the punishment?: Harris
How long were you banned/blacklisted for?: 2 Weeks

Your Steam Name: Borat
Your Roleplay Name: Bob Boogly
Your SteamID: STEAM_0:0:180694545

Why were you banned/blacklisted?: 3.4 - User yelled his location and the fact that he was being held a hostage, whilst being held under gunpoint, resulting in his swift death. // Banned for enforcer Franko - Extended by Haris for 2.5 - User used a molotov in a raid, severely affecting other players without valid justification.

Why should this appeal be considered?: I am disputing the two week additional extension that was placed because I used a Molotov in a raid. I was raiding with four people, two got dropped at the door and they were holding a nasty peek, so I deployed a Molotov for the reason of driving them out of the room. The same group had raided me earlier that day so we had additional RP reason to raid and kill them.

Additional Information: I was given zero opportunity to explain myself and should not be prosecuted so harshly for simply using a Molotov, if it's a bannable offense to use it in combat, maybe have a pop up to let people know not to use that. two weeks is extremely harsh and unjust for what should be proper RP cause to use a Molotov. Additionally please list possible use cases if my use case was invalid.

Were you intending to raid the property for monetary gain or for revenge?

Also please name the people who raided you earlier in the day and did you die in this raid?

I did not die when they raided/mugged me, I was ziptied and mugged and let to live. Both of those reasons contributed to me raiding them, the money and revenge. I do not have the names of the people the reason we knew it was them was because they talked to us and I recognized the voice as well as the visible clothes they were wearing that identified them to me. I did die from our attempted raid after using the molotov.

and yes since I couldn't find any of my clips I cannot identify them by name there's also no way I'll remember their names off my head as this happened weeks ago.

After reviewing your logs and the incident involving @Tony Chopper (the person who mugged you and was present in the apartment you raided), we still strongly disagree with your actions. We find your justification to be lacking, as you claim it was driven by revenge. However, it's important to note that both you and the individual who mugged you have died multiple times since the initial mugging incident, as shown by the images below
The only negative interaction between you and @Tony Chopper occurred eight minutes before their death:

Furthermore, you've also died multiple times:

For reference this is when the raid started:

As shown in the images above, your attempt to justify your actions in seeking revenge is invalid since you have died multiple times since your last interaction with @Tony Chopper. Using this as a reason to justify it is against Rule 3.5, which does not allow acting on information from your previous life. Attempting to justify your actions in this manner is not permissible.

3.5 New Life Rule

When a player has died In Character, and after they have re-spawned, they must wait at least 5 minutes (a countdown is provided) before they may either return to the place where they died and/or interact with the situation. They must also treat their re-spawn as a new life. A system is in place to inform players that they are in breach of this rule, any attempt to bypass this system will not be tolerated. Joining or leaving any government job is to be treated as a new life.

While waiting for their NLR timer to run out, players should not wait in the vicinity of their NLR zone and should stay a reasonable distance away.

When a player is given a new life they must forget/may not act upon any and all details of their previous life; this excludes properties and cars that they own, government positions that they hold and any friends or acquaintances that they have/had made.

Players should not use or act upon any information gained from other players which is relevant to their previous death, while their NLR timer is active.

Moreover, the props inside the property you raided belonged to a different player who had no involvement in the mugging incident and wasn't even present on the server at the time. Even if you had a valid reason for the raid, it is essential to ensure that the props inside are owned by the relevant player. Rule 2.5 clearly states that the use of Molotov cocktails in raids is only acceptable if there have been prior negative interactions that justify their use. In this case, there were no such interactions that would justify your actions. A valid reason would typically involve losing a significant amount of money due to the mugging or raid, but given your multiple deaths since the initial incident, this justification is not applicable.

2.5 Excessive Negativity

Players may not excessively impact the experience of others in a negative manner, unless the actions are a proportionate escalation of negative actions that have been performed against the original player.

When participating in raids, players carrying visible weaponry whilst entering, exiting or inside of the property that is being raided are considered to be significant enough threats to be killed justifiably without prior verbal commands or interaction.

For example, it is not acceptable to:

  • Intentionally mug and target new players.
  • Destroy valuable items due to basic distaste such as product prices.
  • Killing a player over verbal insults, minor or accidental actions.
  • Killing a player after mugging them because they’ve seen your identity.
  • Cause unnecessary damage to a stolen vehicle without good reason.
  • Use explosives or incendiaries without taking precautions to ensure that uninvolved player's items are not damaged.
  • Use molotov cocktails in raids without prior negative interactions which would justify their use.

It is your responsibility to read the server rules, and ignorance of the rules is not an excuse. If you disagree with the length of your ban, you have the option to create a staff complaint regarding the staff member's decision.
