I feel that punishing people OOC (bans and warnings) for breaking a rule from section 4 is unneeded. Instead, I would suggest that the punishments stay IC by having the player face a blacklist instead. I believe that this would be more appropriate as the player is unable to do his job, not unable to abide by the general rules. Of course, if the player did something major a ban or a warning would be more ideal.

This is a discussion, feel free to agree/disagree with me and/or add things to the idea either (cons, pros, additions, problems etc).

It depends on the situation whether a blacklist, a warn or a ban is needed. If a user completely disregards his duty and in doing so hinders others RP to an unreasonable extent then he should be punshed OOC.

This would just limit the punishment given to the extreme cases, which isn't needed.

Example, the mayor breaks law 4.4. Because he broke a law, he breaks the rule 4.1. A warning/ban would be silly, a small blacklist would be a nice "IC" way to punish the guy as he failed to do his duties.
Second example, a taxi driver is bad at driving and sometimes he either crashes on the walls or ignores the speed limit. Giving him a ban or a warning still will not be needed and he should receive a blacklist as his boss would fire him from the job.

What I want to say is, that the rules are here to make this server kinda realistic. You get punished if you do act realistic according to the rules. People might not fit for a job though. Just because they do not fit for that job and cannot do their duties correctly they should "ICly" get punished thus the blacklist. If you want to bring this in real life, people are doing mistakes and might not fit for a job. The boss would fire you from the job (that is the blacklist in game).
