It's no different then a police officer finding 10 people standing on a area that says 'keep of the grass'.
9 of the people on the grass are white. 1 is black.
The police officer decides to go and fine the black guy and not the others.

The officers excuse would be "oh they're all doing it, I just so happened to choose this individual"
